US Inventor Update: What We’re Doing to Restore Your Rights and Good and Bad Legislation in Congress Now

The mission of US Inventor is to restore your ability as an inventor to stop the theft of a patented invention, regardless of how powerful the corporation intent on stealing it. For any of you new to this issue, see a concise description of how our rights have been destroyed.

US Inventor is of inventors and for inventors, and while a few of us are seen most often, there are thousands of our members across America who are actively engaged in this fight. We’re working on many fronts, we’re having an increasing impact and we fully intend to accomplish our mission.

By the way, because of our effectiveness, you may hear of various attacks directed at us. Throughout the history of Earth, individuals and groups making a difference are usually attacked. We see it as validation. Below is an update of what we’ve been doing, but first, I want to inform you of legislation currently in Congress.

Bad Legislation

INVENTORS OPPOSE The Clear Patents Act, HR 5902 (US House)– Representative Darrell Issa – The ITC can be effectively used to stop infringing products from coming into America. Issa’s bill allows any ITC action underway to be stopped if a PTAB action is instituted, and only continued after the PTAB action is concluded (if the patent remains intact).

Basically strengthens the PTAB – one provision explicitly allows government agencies to use the PTAB to invalidate patents!

Good Legislation

INVENTORS SUPPORT The Restoring America’s Leadership in Innovation Act of 2021 (RALIA), HR 5874 – Representative Thomas Massie

Representative Massie is a consistent supporter of Constitutional patent rights and generally recognized as an expert on this issue. You may recall that he was a co-sponsor on a previous bill of ours. RALIA fixes the key issues created by recent bad legislation and judicial decisions, and more. For example, it eliminates the PTAB, restores injunctive relief, and undoes the “abstract idea” decision. If these issues are new for you, see a concise description of our loss of rights.

Call the Congressional switchboard number, (202) 224-3121, ask to be connected to your Representative and Senators (3 calls). Tell them that you want them to support and co-sponsor the Restoring America’s Leadership in Innovation Act of 2021, HR 5874, that this bill is important for his or her constituents and for America. Also tell them that you are opposed to the Clear Patents Act, HR 5902, which will harm inventors and American innovation by allowing China to continue flooding our market with pirated products. Finally, tell them that the Leahy/Cornyn Restoring the America Invents Act, S. 2891, will harm inventors and American innovation, making it easier for big corporations to steal technology and invalidate patents at the PTAB.

US Inventor Sued the USPTO to Cause Official Rule-making

Attorneys advised US Inventor that the text of the America Invents Act (AIA) and the Administrative Procedures Act require the USPTO to do notice and comment rule-making to handle problems being encountered at the PTAB (Patent Trial and Appeal Board). Notice and comment rule-making allows all stakeholders to provide input into what needs to be done to make the PTAB fair. US Inventor sued the USPTO to cause this process to start. The judge dismissed the case, and we are appealing.

We demonstrated at the USPTO in Alexandria, VA, at the regional offices in Detroit, Denver, Dallas, and San Jose, and at the office of Senator Patrick Leahy in Burlington, VT.

US Inventor’s Effective Use of FOIA (Freedom of Information Act) Requests

We’ve done a number of FOIA requests and held firm, even suing to get the information requested. So far, one paper has been published based on this information that indicates a significant tie between the bonus pay of PTAB judges and the invalidation of patents.

US Inventor Influences Lawmakers Through Zoom Meetings

US Inventor has had over 100 Zoom and other meetings in recent months with US Representatives and Senators involving constituent inventors. Your participation is extremely important here because you are who they represent. We’ll let you know when we have something set for your lawmakers, and we’ll provide support and coaching, as well as being in the meeting with you.

Town Hall Meetings

This is one of the best ways to get our issue know to lawmakers. US Inventor has alerted members to over 200 Town Hall meetings this year. You just show up (or log in if it’s online) and make a statement. We provide some information that you can use. Volunteering some time here makes a big impact.

Call to Action

To achieve our mission, we need more inventors and interested individuals helping. Our lawmakers need to know that their voters care. We need to make this issue rise in importance. Here are several things we need you to do:

1) If you haven’t already done so, sign our Inventor Rights Resolution: we need you to do this becasue is allows us to show US Representatives and Senators that their voters care about this issue. This also enables us to let you know when we have a meeting set with your lawmaker that you can join, or when you can attend a Town Hall meeting.

Conclusion

Thank you for your support. We’re moving the ball, and we will not stop until we have restored the rights that the US Constitution says you should have as an inventor. Your right to own what you have invented and patented is your birthright as an American. It is unconscionable that we’ve let a handful of multinational corporations destroy this key part of America.
